Insufficient Evidence Results in the Release of Three Accused of Murder

Three men charged with the murder of Joseph Edward Banda have been discharged due to insufficient evidence. Despite witness statements placing them at the crime scene, the lack of direct evidence led to the discontinuation of the case. Legal representation played a significant role in their release, following nearly two years in custody.

In a recent development in Ntchisi district, three men—Josephy Gladwell Master, Yohane Petro, and Paul Francisco—have been exonerated from murder charges due to a lack of sufficient evidence. The accusation stemmed from the murder of 63-year-old Joseph Edward Banda, whose body was discovered in June 2023 in a maize field, bearing multiple stab wounds after going missing following a drinking outing.

Following the incident, police initiated an investigation which led to the arrest of the three suspects. Although they maintained their innocence, the absence of direct evidence connecting them to the crime proved problematic. The suspects were held in custody based primarily on witness testimonies that suggested they were present at the scene of the crime. They were remanded at Ntchisi Prison pending trial.

Legal representation was provided by Senior Legal Aid Advocates Jacqueline Nthaniko and Chanju Kondowe, thanks to the support of the Legal Aid Bureau. A critical witness had testified seeing Banda somewhat inebriated the evening before his disappearance, as well as encountering the three accused heading in the same direction as him.

After a meticulous examination of the case, the State concluded that the evidence presented was insufficient to support a conviction. Consequently, the State opted to discontinue the case, resulting in the release of the three accused, who had endured nearly two years of incarceration.
